Scope of Application 1.1. These General Conditions of Sale regulate all commercial transactions carried out by IGO PURPLE LDA, operating under the Purplee brand, both in physical stores and remotely (such as the official website). 1.2. These Conditions come into force from January 1, 2025, replacing previous versions, except for contracts already concluded or orders in process on that date. 1.3. By establishing a business relationship with Purplee, the customer fully accepts the terms established herein, unless otherwise previously authorized in writing. 1.4. In the event of contracting through the website, the customer undertakes to use it lawfully, refraining from any activity that violates the law, good customs or the rights of third parties. 1.5. Purplee may change these terms without prior notice, while respecting contracts already signed and in progress. 1.6. A customer is any individual or legal entity that contracts with Purplee to purchase goods or services. The term "consumer" refers to an individual who purchases goods or services for non-professional use.
Prices 2.1. Prices displayed in catalogs, proposals, on the Purplee website or in physical stores are expressed in euros (EUR) and include the legal VAT in force. 2.2. The values presented are valid at the time of viewing, except in the case of an obvious error or stock shortage. 2.3. Purplee reserves the right to update prices at any time, applying the new values to future orders.
Campaigns 3.1. Purplee may modify or cancel current promotional campaigns without prior notice.
Product Specifications 4.1. The technical specifications of products presented in catalogs, technical sheets, or online reflect information valid on the date of their publication. We are not responsible for any obvious errors or outdated information.
Budgets and Proposals 5.1. Commercial proposals issued by Purplee are valid for 15 days, unless otherwise indicated.
Orders 6.1. Orders can be made in person or through the Purplee website. 6.2. To place an order online, prior registration on the website is required. 6.3. Acceptance of the order may be express or result from its execution. 6.4. Order processing is subject to full payment, unless otherwise indicated. 6.5. Any change or cancellation of the order by the customer during processing is subject to validation by Purplee. 6.6. If Purplee proposes changes to the order, they depend on the customer's express acceptance.
Transportation and Delivery 7.1. Shipping costs for products are the customer's responsibility, unless otherwise stated. 7.2. Delivery times are estimates and are not binding on Purplee, unless expressly agreed. 7.3. Purplee cannot be held responsible for delays in delivery beyond its control. 7.4. Delays not attributable to Purplee do not give rise to any right to compensation or cancellations. 7.5. The risk is transferred to the customer upon physical receipt of the goods by the customer or by a designated third party. 7.6. If transport is contracted by the customer, the risk transfers at the time of delivery to the carrier. 7.7. In all other cases, the risk transfers upon delivery to the carrier, even if contracted by Purplee. 7.8. The customer must check the integrity of the products upon delivery and immediately report any visible damage. 7.9. Damage not detected at the time of delivery must be reported in writing to Purplee within three working days.
Payment 8.1. Payments can be made by cash, debit/credit card, MB Way, Klarna, or other methods available at the time of purchase. 8.2. In special cases, Purplee may allow installment payments to customers with a positive history. 8.3. Failure to comply with the payment deadline implies immediate termination of the contract, with legal consequences. 8.4. Failure to pay an installment may result in the maturity of the remaining installments. 8.5. Discounts, promotions or sales follow current legislation. 8.6. Alternative payment methods such as FLOA BANK are subject to approval by the financial institution and may involve sharing data with that institution for credit analysis.
Intellectual Property 9.1. All content available on the Purplee website and platforms associated with Purplee is the exclusive property of IGO PURPLE LDA. 9.2. Reproduction, modification or distribution without prior authorization from Purplee is prohibited.
Legal Guarantee 10.1. Goods supplied to consumers benefit from a legal guarantee of three years from delivery. 10.2. After two years, it is up to the consumer to demonstrate that the lack of conformity existed at the time of delivery. 10.3. Non-compliance must be communicated to Purplee in writing, preferably via the online form. 10.4. The product may undergo technical evaluation to verify non-compliance. 10.5. The product must be shipped with an invoice and a description of the defect. 10.6. If non-compliance is confirmed, repair, replacement, price reduction or termination of the contract will be carried out, in accordance with legal terms. 10.7. The consumer may directly opt for replacement or resolution if the failure occurs within the first 30 days. 10.8. Transport costs arising from the warranty are borne by Purplee. 10.9. For companies, defects must be reported within 30 days of discovery and within a maximum of 6 months after delivery.
Additional Guarantees (Voluntary) 11.1. Purplee may provide additional commercial guarantees upon contracting. 11.2. These guarantees extend legal coverage and apply exclusively to mainland Portugal. 11.3. Conditions and exclusions are provided at the time of contracting. 11.4. Cases of misuse, tampering or external damage exclude additional coverage.
Right of Free Resolution 12.1. For online purchases, the consumer may terminate the contract within 14 days of receipt. 12.2. The product must be returned in the same conditions in which it was delivered, with original packaging. 12.3. Certain products, for hygiene or personalization reasons, are excluded from the right of return. 12.4. The return must be communicated in writing using the online form. 12.5. Return costs are borne by the customer, unless otherwise agreed. 12.6. The refund will be made using the same payment method used for the purchase.
Applicable Law and Dispute Resolution 13.1. All transactions are subject to Portuguese law. 13.2. To resolve consumer disputes, the customer may resort to alternative dispute resolution (ADR) entities. The list is available at www.consumidor.gov.br . 13.3. The European Commission provides the ODR platform for online dispute resolution at: https://ec.europa.eu/consumers/odr
Product Collection and Survey 14.1. The customer must collect the product within 15 days after notification. 14.2. After this period, the product will be sent to the warehouse and stored for up to 90 days. 14.3. If this period has elapsed without withdrawal, the product will be considered abandoned under legal terms.
Packaging Reuse and Waste 15.1. Purplee is committed to ensuring the correct disposal of packaging waste, in accordance with current environmental legislation.
